🌶 Chili Crunch Jelly Rolls represent a delectable combination. With apologies to lovers of treats like the 🌮Taco Bell Doritos Locos Tacos and the Dairy Queen 🍨Oreo Blizzard, this combination is not the next addictive cross-branded gastrological masterpiece (yet). Rather, Chili Crunch Jelly Rolls, digested properly, combine to be a tasty recipe for brand strategy lessons. While I must admit as I write this, I have become inspired to tinker in my kitchen to develop a Chili Crunch Jelly Roll at home (I’ll report the results!), for now, I’ll settle for examining these two recent pop-culture trademark stories for their munchable trademark tip takeaways. Second, we wanted to provide you with updates on some of our most popular articles: Queen of 🎄Christmas Sued for Copyright Infringement – Again – In November 2023, Mariah Carey was named in a lawsuit in federal district court for copyright infringement. The plaintiffs, 🎼musicians Andy Stone (stage name “Vince Vance”) and Troy Powers, allege that the so-called “Queen of Christmas” used their country music song “All I want for Christmas is You” as the basis for her hit pop song with the same title. Carey has filed an answer to the complaint, calling plaintiffs’ claims, “outrageous and insulting” and questioning why it took nearly thirty years for them to come forward. Carey’s answer claps back at plaintiffs calling their song “obscure” and contending that plaintiffs unlawfully copied their song from earlier songs, “including Bobby Vinton’s 1964 My Heart Belongs Only to You.” Tattoo Copyright Chronicles – Kat Von D, star of the reality 📺 TV series LA Ink, won at trial after being sued for copyright infringement by photographer Jeff Sedlik over Kat’s use of Sedlik’s iconic photograph of Miles Davis. Kat tattooed the image on her friend and posted the finished work on social media. The case went to trial, and a jury decided that the tattoo was not substantially similar to the photograph, and that Kat’s online posts were non-infringing acts of fair use. National 🥔Potato Chip Day in the US was on March 14, 2024. We hope you celebrated accordingly. We celebrated by reading up on an ongoing patent infringement lawsuit between two potato chip manufacturers. The dispute began in 2016 when chip-maker Simplot sued rival chip-maker McCain, alleging that McCain’s spiral-cut “Twisted Potato” design infringed Simplot’s design patent US D640036 for a “Spiral Potato Piece.” A few months later, McCain counter sued alleging that Simplot’s spiral-cut “Sidewinders” infringed McCains’ design patent US D720916 for a “Root Vegetable Product.” McCain also alleged that Simplot’s chips infringed its utility patent US 6821540 for a “Process for Treating 🥕Vegetables and 🍐Fruit Before Cooking” involving the use of a “pulse electric field” to soften fruits and vegetables before they are cut. President Donald Trump recently began promoting a brand-new pair of limited edition 👟sneakers for sale bearing a T logo, 🇺🇸 American flag design, 💛gold upper, and red sole bottom. The $399 sneakers are called the “Never Surrender High-Top” and are already sold out according to the Trump sneakers website, gettrumpsneakers.com. The website selling the sneakers claims not to have any political affiliation, however, Trump is publicly endorsing the product, and the shoes are branded with a T logo, presumably, as an indicator of the President’s brand. A review of the U.S. Trademark Office’s online database records did not reveal any applications or registrations for a T logo reciting clothing or footwear by the President or his companies. Although trademark rights can accrue through use, registering trademarks confers significant benefits. The lack of a trademark registration may be the least of the intellectual property concerns surrounding the new sneakers. Recently, some sexually explicit photographs of 🎙Taylor Swift went viral on social media platform X (formerly Twitter). These images were 🤖deepfakes—AI generated images of Swift. The issue of deepfakes has been making headlines as the US enters another presidential election cycle, due largely to concerns over the potentially deleterious effects of misinformation on voters. Congress is considering various bills to try to curb the spread of deepfakes online, including criminal and civil penalties for unauthorized production of deepfake content. Swift’s fans did not wait for a Congressional act. Instead, they took up the online campaign by flooding social media with positive images of Swift and the hashtag #ProtectTaylorSwift.
